دأبت اسرائيل، دولة الاحتلال والفصل العنصري، على ارتكاب الجرائم الدولية ضد شعبنا الفلسطيني. ففي كل عدوان يشنه كيان الاحتلال، بتسهيل وتواطؤ من قادة المركز الامبريالي العالمي، وفي مقدمتهم قادة الولايات المتحدة والمملكة المتحدة، لا يتوانى الكيان؛ قادة وجنوداً ومستوطنين، عن اقتراف جرائم الحرب والجرائم ضد الإنسانية بحق الشعب الفلسطيني وسكان قطاع غزة. ومن السابع من اكتوبر/تشرين أول الجاري ، يشن كيان الاحتلال؛ بتواطؤ وتسهيل من قادة عدد من الدول الغربية، حرباً قد ترتقي إلى إبادة جماعية موصوفة، وما جريمة المستشفى المعمداني إلا حلقة من حلقاتها الممنهجة والمخطط لها بعناية.

ومع استمرار قطع الكهرباء ومنع ادخال الوقود فان هناك خطرا وشيكا على توقف المستشفيات عن العمل، وخاصة غرف العناية المشددة وتوليد الاكسجين وغسيل الكلى، وتوقف مركبات الإسعاف والدفاع المدني عن تقديم أي خدمات. وحيث أن 42% من مساكن غزة قد هدمت كليا او تضررت جزئيا، ووجود مليون وستمائة الف مشرد اخرجوا قسرا من منازلهم، فان أية أمطار تنزل في هذا الموسم سوف تؤدي الى كوارث إضافية لتشكل حلقة متقدمة من حلقات الإبادة.

إزاء جرائم الحرب والعدوان والإبادة الجماعية المستمرة بحق سكان قطاع غزة من أبناء الشعب الفلسطيني، وإزاء إخفاق جميع الجهود المبذولة منذ سنوات لإستثمار آلية الملاحقة التي يوجدها نظام روما المنشيء للمحكمة الجنائية الدولية، لأسباب عديدة لا مجال لذكرها في هذا المقام، فإننا ندعو إلى توظيف الإمكانات القانونية المتاحة بمقتضى اتفاقية منع جريمة الإبادة الجماعية والمعاقبة عليها لعام 1948 ، والممارسة العملية والقضائية المتعلقة بها، وبخاصة أن كيان الاحتلال وعدد لا بأس به من الدول العربية أطراف في الاتفاقية، ولم تتحفظ على الحكم الوارد في المادة (9) من الاتفاقية؛ الذي تقر الدول الأطراف بموجبه اختصاص محكمة العدل الدولية بحق أي طرف من الدول الأطراف المتنازعة بإحالة النزاعات التي قد تنشأ بين الأطراف بشأن تفسير أو تطبيق أو تنفيذ الاتفاقية، بما في ذلك النزاعات المتصلة بمسؤولية دولة ما عن إبادة جماعية، أو عن التآمر أو التحريض على ارتكابها.

ولما كانت الأفعال الجرمية التي يقترفها كيان الاحتلال بحق أبناء الشعب الفلسطيني في قطاع غزة تنطوي على إخضاع سكان قطاع غزة، عمداً، لظروف معيشية يراد من ورائها تدمير سكان القطاع الفلسطيني تدميراً مادياً كلياً أو جزئياً، وبصورة ممنهجة تعبر عن نسق عام، فإننا نطالب بالآتي:

أولاً: أن تبادر أي من الدول الأطراف في الاتفاقية المذكورة، وفي مقدمتها الدول العربية والإسلامية الأطراف، إلى الطلب من محكمة العدل الدولية باستصدار أمر مستعجل يطالب كيان الاحتلال والفصل العنصري بوقف أنشطته الجرمية في قطاع غزة.

ثانياً: إقامة دعوى ضد كيان الاحتلال وأية دولة ساهمت وأيدت وتواطأت معه على ارتكاب الإبادة الجماعية بحق أبناء الشعب الفلسطيني في قطاع غزة، لتحميلها المسؤولية القانونية الدولية عن تلك الأفعال.

ثالثاً: أن تبادر الدول إلى اتخاذ إجراءات مضادة ضد كيان الاحتلال، ومن تواطأ معه أو سهل له ارتكاب جرائم الإبادة الجماعية في قطاع غزة، ومن بينها مقاطعة الكيان اقتصادياً، وقطع العلاقات الدبلوماسية معه وعدم الاعتراف بأي أوضاع واقعية قد تنشأ عن تلك الأفعال الجرمية.

255 Human Rights Organizations and Networks Urge States Parties to the Convention of Preventing the Crime of Genocide to Request the International Court of Justice to Issue an Urgent Order Demanding that the Occupying State Stop its Criminal Activities in the Gaza Strip

Israel, the occupying and apartheid state, has continued to commit international crimes against the Palestinian people. In every aggression launched by the occupying entity, with the facilitation and complicity of the leaders of the global imperialist center, led by the leaders of the United States and the United Kingdom, the occupying state - its leaders, soldiers, and settlers - do not hesitate to commit war crimes and crimes against humanity against the Palestinian people and the residents of the Gaza Strip. From October 7^th, the occupation entity launches, with the complicity and facilitation of the leaders of a number of Western countries, a war that may rise to be described as genocide. The Baptist Hospital crime is only one of its carefully planned and systematic episodes.

As electricity and fuel cut continues, there is an imminent danger that hospitals will stop working, especially intensive care rooms, oxygen generation, and dialysis, and that ambulances and civil defense vehicles will stop providing any services. Since 42% of Gaza's housing has been completely demolished or partially damaged, and there are one million six hundred thousand displaced people who have been forcibly removed from their homes, any rain that falls this season will lead to additional disasters, forming an advanced episode of genocide.

In view of the ongoing war crimes, aggression, and genocide against the Palestinian population of the Gaza Strip, and in view of the failure of all efforts made for years to exploit the prosecution mechanism established by the Rome Statute that established the International Criminal Court, for many reasons that cannot be mentioned here, we call for the use of legal capabilities available under the Convention on the Prevention and Punishment of the Crime of Genocide of 1948, , and the practical and judicial practice related to it. We note that the occupying state and a significant number of Arab countries are parties to the Convention, and did not submit any reservations regarding the provision contained in Article (9) of the Convention; under which the States Parties acknowledge the jurisdiction of the International Court of Justice, the right of any party to the conflicting States Parties to refer disputes that may arise between the parties regarding the interpretation, application, or implementation of the Convention, including disputes related to the responsibility of a State for genocide, or for conspiracy or incitement to commit it.

Since the criminal acts committed by the occupying entity against the Palestinian people in the Gaza Strip involve intentionally subjecting the residents of the Gaza Strip to living conditions that are intended to physically destroy the population of the Palestinian Strip, in whole or in part, in a systematic manner that expresses a general pattern, we demand the following:

First: That any of the state’s parties to the aforementioned agreement, especially the Arab and Islamic states parties, take the initiative to request the International Court of Justice to issue an urgent order requiring the occupation and apartheid entity to stop its criminal activities in the Gaza Strip.

Second: File a lawsuit against the occupying entity and any country that contributed, supported, or colluded with it to commit genocide against the Palestinian people in the Gaza Strip, to hold it internationally and legally responsible for those actions.

Third: That countries take the initiative to take countermeasures against the occupying entity and those who colluded with it or facilitated the commission of genocide crimes in the Gaza Strip, including an economic boycott of the entity, severing diplomatic relations with it, and not recognizing any realistic situations that may arise from these criminal acts.

255 organisations et réseaux de défense des droits de l'homme exhortent les États parties à la Convention pour la prévention du crime de génocide à demander à la Cour internationale de justice de rendre une ordonnance urgente exigeant que l'État occupant mette fin à ses activités criminelles dans la bande de Gaza.

Israël, l'État d'occupation et d'apartheid, n’a cessé de commettre des crimes internationaux contre le peuple palestinien. Lors de chaque agression lancée par l'entité occupante, avec la facilitation et la complicité des dirigeants du centre de l’impérialisme mondial, dirigé par les leaders des États-Unis et du Royaume-Uni, l'entité n'hésite pas, dirigeants, soldats et colons, à commettre des crimes de guerre et des crimes contre l'humanité à l'encontre du peuple palestinien et des résidents de la bande de Gaza. À partir du 7 octobre de ce mois, l'entité d'occupation lance, avec la complicité et la facilitation des dirigeants d'un certain nombre de pays occidentaux, une guerre qui peut être qualifiée de génocide, et le crime de l'Hôpital Baptiste n'est que l'un de ses épisodes soigneusement planifiés et systématiques.

Les coupures d'électricité et de carburant se poursuivant, il existe un risque imminent que les hôpitaux cessent de fonctionner, en particulier les salles de soins intensifs, la production d'oxygène et les dialyses, et que les ambulances et les véhicules de la défense civile cessent d'assurer leurs services. Étant donné que 42 % des habitations de Gaza ont été complètement démolies ou partiellement endommagées, et qu'un million six cent mille personnes déplacées ont été chassées de force de leurs maisons, toute pluie qui tombera cette saison entraînera des catastrophes supplémentaires, ce qui constitue un épisode avancé de génocide.

Au vu des crimes de guerre, de l'agression et du génocide en cours contre la population palestinienne de la bande de Gaza, et au vu de l'échec de tous les efforts déployés depuis des années pour exploiter le mécanisme de suivi établi par le Statut de Rome qui a créé la Cour pénale internationale, pour de nombreuses raisons qu'il est impossible de mentionner ici, nous appelons à l'utilisation des pouvoirs juridiques disponibles en vertu de la Convention pour la prévention et la répression du crime de génocide de 1948, et de la pratique judiciaire qui s'y rapporte, d'autant plus que l'entité occupante et un nombre important de pays arabes sont parties à la Convention, et n'ont pas émis de réserves concernant les dispositions contenues dans l'article (9) de la Convention, dispositions en vertu desquelles les États parties reconnaissent la compétence de la Cour internationale de justice, le droit de toute partie parmi les États parties en conflit de soumettre les différends qui pourraient surgir entre les parties concernant l'interprétation, l'application ou la mise en œuvre de la convention, y compris les différends relatifs à la responsabilité d'un État pour génocide, ou pour entente ou incitation à le commettre.

Étant donné que les actes criminels commis par l'entité occupante contre le peuple palestinien dans la bande de Gaza consistent à soumettre intentionnellement les résidents de la bande de Gaza à des conditions de vie qui visent à détruire physiquement la population de la bande de Gaza, en tout ou en partie, et d'une manière systématique, ce qui est l’expression d’une démarche générale, nous demandons ce qui suit:

Premièrement : Que n'importe lequel des États parties à l'accord susmentionné, en particulier les États arabes et islamiques, prenne l'initiative de demander à la Cour internationale de justice d'émettre une ordonnance urgente exigeant que l'entité d'occupation et d'apartheid mette fin à ses activités criminelles dans la bande de Gaza.

Deuxièmement : intenter une action en justice contre l'entité occupante et contre tout pays qui a contribué, soutenu ou s'est associé à elle pour commettre un génocide contre le peuple palestinien dans la bande de Gaza, afin de la tenir internationalement et légalement responsable de ces actes.

Troisièmement: que les pays prennent l'initiative de prendre des mesures de rétorsion contre l'entité occupante et contre ceux qui se sont associés à elle ou ont facilité la commission du crime de génocide dans la bande de Gaza, y compris un boycott économique de l'entité, la rupture des relations diplomatiques avec elle, et le refus de reconnaitre tout fait accompli qui pourrait résulter de ces actes criminels.

255 Organizaciones y redes de derechos humanos instan a los Estados Partes en la Convención para la Prevención del Delito de Genocidio a solicitar a la Corte Internacional de Justicia que emita una orden urgente exigiendo al Estado ocupante que ponga fin a sus actividades criminales en la Franja de Gaza.

Israel, el Estado ocupante y de apartheid, ha seguido cometiendo crímenes internacionales contra el pueblo palestino. En cada agresión lanzada por la entidad ocupante, con la facilitación y complicidad de los dirigentes del centro imperialista mundial, encabezados por los dirigentes de Estados Unidos y el Reino Unido, el Estado ocupante -sus dirigentes, soldados y colonos- no dudan en cometer crímenes de guerra y crímenes contra la humanidad contra el pueblo palestino y los residentes de la Franja de Gaza. A partir del 7 de octubre, la entidad ocupante lanza, con la complicidad y la facilitación de los dirigentes de varios países occidentales, una guerra que puede llegar a calificarse de genocidio. El crimen del Hospital Baptist es sólo uno de sus episodios cuidadosamente planificados y sistemáticos.

Mientras continúen los cortes de electricidad y combustible, existe el peligro inminente de que los hospitales dejen de funcionar, especialmente las salas de cuidados intensivos, la generación de oxígeno y la diálisis, y de que las ambulancias y los vehículos de defensa civil dejen de prestar servicio alguno. Dado que el 42% de las viviendas de Gaza han sido completamente demolidas o parcialmente dañadas, y que hay un millón seiscientas mil personas desplazadas que han sido sacadas a la fuerza de sus hogares, cualquier lluvia que caiga esta temporada provocará desastres adicionales, formando un episodio avanzado de genocidio.

En vista de los continuos crímenes de guerra, agresión y genocidio contra la población palestina de la Franja de Gaza, y en vista del fracaso de todos los esfuerzos realizados durante años para explotar el mecanismo de enjuiciamiento establecido por el Estatuto de Roma que estableció la Corte Penal Internacional, por muchas razones que no se pueden mencionar aquí, hacemos un llamamiento para el uso de las capacidades legales disponibles en virtud de la Convención para la Prevención y la Sanción del Delito de Genocidio de 1948, y la práctica y la práctica judicial relacionada con ella. Tomamos nota de que el Estado ocupante y un número significativo de países árabes son partes en la Convención, y no presentaron ninguna reserva con respecto a la disposición contenida en el artículo (9) de la Convención; en virtud del cual los Estados Partes reconocen la jurisdicción de la Corte Internacional de Justicia, el derecho de cualquiera de las partes a los Estados Partes en conflicto a someter las controversias que puedan surgir entre las partes con respecto a la interpretación, aplicación o ejecución de la Convención, incluidas las controversias relacionadas con la responsabilidad de un Estado por genocidio, o por conspiración o incitación para cometerlo.

Dado que los actos criminales cometidos por la entidad ocupante contra el pueblo palestino en la Franja de Gaza implican someter intencionadamente a los residentes de la Franja de Gaza a condiciones de vida que pretenden destruir físicamente a la población de la Franja de Palestina, en su totalidad o en parte, de una manera sistemática que expresa un patrón general, exigimos lo siguiente:

Primero: Que cualquiera de los estados parte del mencionado acuerdo, especialmente los estados parte árabes e islámicos, tomen la iniciativa de solicitar a la Corte Internacional de Justicia que emita una orden urgente exigiendo a la entidad de ocupación y apartheid que ponga fin a sus actividades criminales en la Franja de Gaza.

Segundo: Presentar una demanda contra la entidad ocupante y contra cualquier país que haya contribuido, apoyado o coludido con ella para cometer genocidio contra el pueblo palestino en la Franja de Gaza, para responsabilizarla internacional y legalmente de esas acciones.

Tercero: Que los países tomen la iniciativa de adoptar contramedidas contra la entidad ocupante y quienes se confabularon con ella o facilitaron la comisión de crímenes de genocidio en la Franja de Gaza, incluido un boicot económico a la entidad, la ruptura de relaciones diplomáticas con ella y el no reconocimiento de ninguna situación realista que pueda derivarse de estos actos criminales.

255 Menschenrechtsorganisationen und -netzwerke fordern die Vertragsstaaten der “Konvention zur Verhütung des Völkermordes“ auf, den Internationalen Gerichtshof um eine dringende Anordnung zu ersuchen, die den Besatzungsstaat auffordert, seine kriminellen Aktivitäten im Gazastreifen einzustellen

Israel, der Besatzer- und Apartheidstaat, begeht weiterhin internationale Verbrechen gegen das palästinensische Volk. Bei jedem Angriff der Besatzungsmacht - erleichtert und unterstützt durch den westlichen Staaten unter der Führung der USA und Großbritanniens - zögern die Leiter, Soldaten und Siedler des Besatzungsstaat nicht, Kriegsverbrechen zu begehen und Verbrechen gegen die Menschlichkeit gegen das palästinensische Volk und die Bewohner des Gazastreifens auszuführen. Am 7. Oktober begann die Besatzungsmacht mit der Komplizenschaft und Unterstützung der Leiter einer Reihe westlicher Länder einen Krieg, der als Völkermord bezeichnet werden kann. Das Verbrechen am Baptist Hospital ist nur eine der sorgfältig geplanten und systematischen Episoden.

Da die Strom- und Treibstoffversorgung weiterhin unterbrochen ist, besteht die unmittelbare Gefahr, dass die Krankenhäuser, insbesondere die Intensivstationen, die Sauerstoffversorgung und die Dialyse, sowie die Krankenwagen und die Fahrzeuge des Zivilschutzes ihren Dienst einstellen müssen. Da 42 % der Häuser im Gazastreifen vollständig zerstört oder teilweise beschädigt sind und eine Million sechshunderttausend Menschen gewaltsam aus ihren Häusern vertrieben wurden, wird jeder Regen, der in dieser Jahreszeit fällt, zu weiteren Katastrophen führen und die Lebensumstände verschlimmern.

Angesichts der andauernden Unterdrückung der palästinensischen Bevölkerung des Gazastreifens und angesichts des Scheiterns des Römischen Statuts des Internationalen Strafgerichtshof, fordern wir, die Befugnisse und die gerichtliche Praxis zu nutzen, die durch die Konvention über die Verhütung und Bestrafung des Völkermordes von 1948 zur Verfügung stehen. Wir stellen fest, dass der Besatzerstaat und eine beträchtliche Anzahl arabischer Länder Vertragsparteien der Konvention sind und keine Vorbehalte zu der in Artikel (9) der Konvention enthaltenen Bestimmung angemeldet haben, wonach die Vertragsstaaten die Zuständigkeit des Internationalen Gerichtshofs anerkennen. Dazu gehört das Recht jeder Vertragspartei, die Konfliktparteien mit Streitigkeiten zu befassen, die sich zwischen den Vertragsparteien über die Auslegung, Anwendung oder Durchführung der Konvention ergeben können, einschließlich Streitigkeiten im Zusammenhang mit der Verantwortung eines Staates für Völkermord oder für die Verschwörung oder Anstiftung zu dessen Begehung.

Da die kriminellen Handlungen der Besatzungsmacht gegen das palästinensische Volk im Gazastreifen darin bestehen, die Bewohner des Gazastreifens vorsätzlich Lebensbedingungen auszusetzen, die darauf abzielen, die Bevölkerung des Gazastreifens ganz oder teilweise systematisch und nach einem allgemeinen Muster physisch zu vernichten, fordern wir Folgendes:

Erstens: Alle Vertragsstaaten des oben genannten Abkommens, insbesondere die arabischen und islamischen Vertragsstaaten, sollen die Initiative ergreifen und den Internationalen Gerichtshof auffordern, eine dringende Anordnung zu erlassen, die das Besatzungs- und Apartheidregime auffordert, seine kriminellen Aktivitäten im Gazastreifen einzustellen.

Zweitens: Klage gegen die Besatzungsmacht und alle Länder, die dazu beigetragen, sie unterstützt oder mit ihr konspiriert haben, Völkermord an der palästinensischen Bevölkerung im Gazastreifen zu begehen, um sie international und rechtlich für diese Handlungen verantwortlich zu machen.

Drittens: Die Länder sollen die Initiative ergreifen, um Gegenmaßnahmen gegen die Besatzungsmacht und diejenigen zu ergreifen, die mit ihr konspiriert oder die Begehung von Völkermordverbrechen im Gazastreifen erleichtert haben, einschließlich eines Wirtschaftsboykotts gegen die Besatzungsmacht, des Abbruchs der diplomatischen Beziehungen zu ihr und der Nichtanerkennung jeglicher realistischen Situationen, die sich aus diesen kriminellen Handlungen ergeben könnten.

255 organizzazioni e reti per i diritti umani esortano gli Stati firmatari della Convenzione per la prevenzione del crimine di genocidio a richiedere alla Corte internazionale di giustizia di emettere un'ordinanza urgente che imponga allo Stato occupante di interrompere le sue attività criminali nella Striscia di Gaza

Israele, lo Stato di occupazione e di apartheid, continua a commettere crimini internazionali contro il popolo palestinese. In ogni aggressione lanciata dallo Stato di occupazione, con la facilitazione e la complicità dei dirigenti del centro dell’imperialismo globale, guidato dagli Stati Uniti e dal Regno Unito, l'entità – i suoi dirigenti, le sue forze armate, e i suoi coloni – non esitano a commettere crimini di guerra e crimini contro l'umanità contro il popolo palestinese e i residenti della Striscia di Gaza. Dal 7 ottobre, l'entità di occupazione lancia, con la complicità e la facilitazione dei dirigenti di alcuni Paesi occidentali, una guerra paragonabile ad un genocidio. Il crimine all’Ospedale Battista è solo uno degli episodi di questi crimini sistematicamente ed attentamente pianificati.

Con il continuo taglio dell'elettricità e del carburante, si pone il pericolo imminente che gli ospedali smettano di funzionare, in particolare le sale di terapia intensiva, la produzione di ossigeno e la dialisi; e che le ambulanze e i veicoli della protezione civile smettano di fornire qualsiasi servizio. Poiché il 42% delle abitazioni di Gaza è stato completamente demolito o parzialmente danneggiato e ci sono un milione e seicentomila sfollati che sono stati rimossi con la forza dalle loro case, ogni pioggia che cadrà in questa stagione porterà a ulteriori disastri, formando un episodio avanzato di genocidio.

Alla luce dei crimini di guerra, dell'aggressione e del genocidio in corso contro la popolazione palestinese della Striscia di Gaza, e in considerazione del fallimento di tutti gli sforzi compiuti per anni per sfruttare il meccanismo di perseguimento stabilito dallo Statuto di Roma che ha istituito la Corte penale internazionale, chiediamo di utilizzare le capacità legali disponibili nell'ambito della Convenzione sulla prevenzione e la punizione del crimine di genocidio del 1948, e la prassi pratica e giudiziaria ad essa correlata. Notiamo che l'entità occupante e un numero importante di Paesi arabi sono firmatari senza aver espresso alcuna riserva riguardo alla disposizione contenuta nell'articolo (9) della Convenzione, in base al quale gli Stati firmatari riconoscono la giurisdizione della Corte internazionale di giustizia, il diritto di qualsiasi Stato firmatario di riferire le controversie che possono sorgere tra le parti in merito all'interpretazione, all'applicazione o all'attuazione della Convenzione – comprese le controversie relative alla responsabilità di uno Stato per genocidio, o per cospirazione o incitamento a commetterlo.

Poiché gli atti criminali commessi dall'entità occupante contro il popolo palestinese nella Striscia di Gaza implicano il sottoporre intenzionalmente i residenti della Striscia di Gaza a condizioni di vita che mirano a distruggere fisicamente la popolazione della Striscia di Palestina, in tutto o in parte, in modo sistematico che esprime un modello generale, chiediamo quanto segue:

Primo: Che tutti gli Stati firmatari del suddetto accordo, in particolare gli Stati arabi e islamici, prendano l'iniziativa di chiedere alla Corte internazionale di giustizia di emettere un'ordinanza urgente che imponga all'entità di occupazione e di apartheid di cessare le sue attività criminali nella Striscia di Gaza.

Secondo: intentare una causa legale contro l'entità di occupazione e tutti i Paesi che hanno contribuito, sostenuto o colluso con essa per commettere un genocidio contro il popolo palestinese nella Striscia di Gaza, per ritenerla responsabile internazionalmente e legalmente di tali azioni.
