181 Organización de derechos humanos exige una sesión urgente de la Asamblea General

Sobre la base de la decisión "Unidos pro Paz" y la formación de una Corte Penal Internacional Especial

Desde el 7 de octubre, el Estado ocupante y del apartheid libra una guerra sin controles ni restricciones legales y morales, a través de la cual comete diversos tipos de crímenes internacionales, y no duda en utilizar las  armas internacionalmente prohibidas en su poder. No le importan los principios básicos del derecho internacional humanitario ni del derecho internacional  de los derechos humanos, y los quebranta cada día más. Sus flagrantes violaciones del derecho internacional son indiferentes a cualquier principio o norma imperativa internacional. Por otro lado, nos encontramos  con que los Estados Unidos de América participan en la agresión enviando su flota y sus soldados a la región, y la Unión Europea también alienta la agresión recurriendo a un silencio ensordecedor e inaceptable sobre los crímenes cometidos por Israel tanto desde el punto de vista jurídico como moral. Además, el Consejo de Seguridad;  a pesar de las graves violaciones del derecho internacional público, la Carta de las Naciones Unidas, los derechos humanos y el derecho internacional humanitario que constituyen una amenaza a la paz y la seguridad internacionales; está paralizado e incapaz de cumplir con sus responsabilidades estipuladas en la Carta de las Naciones Unidas.

Nos enfrentamos a la continuación  de la comisión de crímenes internacionales por parte de la entidad ocupante, mencionamos el crimen de genocidio, el artículo 6 del Estatuto de Roma, los crímenes de guerra, el artículo 8, un crimen contra la humanidad, el artículo 7, y el crimen de agresión, el artículo 5 contra el pueblo palestino  en la Franja de Gaza, y en vista del silencio del Consejo de Seguridad y de las Naciones Unidas,  y por nuestra preocupación por preservar un mínimo de principios básicos del derecho internacional que se violan día tras día debido a la agresión criminal contra el pueblo palestino en la Franja  de Gaza y en toda Palestina, llamamos al Secretario General de las Naciones Unidas a condenar a Israel y tomar las medidas necesarias para proteger a los civiles en Gaza, además,  A la luz de la suspensión del Consejo de Seguridad por parte de los Estados  Unidos de América, hacemos un llamamiento a la Asamblea General para que celebre un período de sesiones urgente sobre la base de la resolución "Unidos por la paz" para examinar la situación en la Franja de Gaza y los territorios palestinos ocupados, y para que adopte las siguientes medidas:

Primero: Trabajar de inmediato para detener la agresión israelí contra Gaza, condenando los crímenes del Estado ocupante del apartheid y su continua agresión contra la Franja de Gaza, y considerándola una amenaza para la paz y la seguridad internacionales.

Segundo: Hacer hincapié en el derecho del pueblo palestino a la libre determinación y la libertad, su derecho a regresar a sus tierras y su derecho a la resistencia, incluida la lucha armada, contra la ocupación.

Tercero: Formar una corte penal internacional especial cuya misión exclusiva sea juzgar a todos los responsables de la comisión  de crímenes de agresión, crímenes de guerra, crímenes de lesa humanidad y el crimen de genocidio.

Cuarto: Subrayar que la entidad ocupante no tiene derecho a la legítima defensa porque es ocupante, y que un ocupante no tiene derecho a utilizar la legítima defensa frente a una situación que provocó con su ocupación flagrante y su continua agresión contra el pueblo palestino y la denegación de su derecho a la libre determinación.

Quinto: Exigir a todos los  países libres que cumplan sus obligaciones y responsabilidades jurídicas y que trabajen para poner fin a los crímenes cometidos por la entidad ocupante contra los residentes de la Franja de Gaza, poner fin al asedio impuesto a la Franja de Gaza y proporcionar de inmediato la asistencia financiera y humanitaria necesaria a la población de la zona y proporcionarles lo que garantice su vida,  necesidades médicas y humanitarias. Así como poner fin de inmediato a los ataques de colonos fuertemente armados y del ejército israelí de ocupación contra mujeres y hombres palestinos en Cisjordania, y tomar medidas especiales para proteger a los prisioneros palestinos en las cárceles sionistas que son objeto de represalias brutales al margen de todas las leyes, obligaciones y moral.

Sexto: Responsabilizar legalmente por ello a todos los que planearon o alentaron a la entidad ocupante a cometer sus horribles crímenes, ya sean de otros países o de dirigentes de otros países.

Para concluir, recordamos a las Naciones Unidas que su responsabilidad por Palestina en virtud del derecho internacional y por el ejercicio por el pueblo palestino de su pleno derecho a la libre determinación sigue existiendo, lo que fue confirmado por la Corte Internacional de Justicia en la opinión consultiva de la Corte Internacional de Justicia sobre el muro de separación de 2004. También instamos a que se active y desarrolle la labor del Comité de las Naciones Unidas que se ocupa del ejercicio de los derechos inalienables del pueblo palestino
